The information that you provide to us in the course of your application for employment with us as well as other information relating to you will be treated in a secure and confidential manner as set out in this job candidate privacy notice (hereinafter referred to as "Notice"). 

1. Data Controller 

DKSH BRN Sdn Bhd and/or its subsidiaries and/or affiliated companies shall be referred collectively as the “Group”. The entity in which you have applied for a position shall be referred to individually as the “Company”. The Company shall be the Data Controller for the purpose of this notice. However, in case of a spontaneous application through our global job application website at https://jobs.dksh.com/, the Data Controller is DKSH Holding Ltd. with its registered office at Wiesenstrasse 8, P.O. 2. Personal Data We Collect 

We may collect and process various types of personal data related to you such as the following:- 

1. Data about you: forename and surname, gender, nationality, civil/marital status, date of birth, age, home contact details (e.g., address, telephone number, e-mail), emergency contact details (name and telephone number) national ID number or passport number, immigration and eligibility to work data, next-of-kin/dependent contact information. 
2. Data about your employment history and qualifications: education records, professional qualifications, references.
3. Data about your application: CV and application, interview data, audio and video recordings of interviews, verification of references.
4. Legal and criminal records data: in compliance with the applicable laws and/or for specific circumstances (e.g., for candidates for positions in the Finance Department).

The above shall be referred collectively as “Personal Data”. 

3. How We Collect Your Personal Data 

Personal Data is collected through the recruitment process, either directly from your application or further verbal and/or written communication, such as the interview process with HR and/or hiring manager.  

Personal Data may also be collected from third parties such as other employees, recruiters, references from your previous place of employment, business partners, sub-contractors providing recruiting or technical services, analytics providers (such as companies that benchmark professional careers), background check providers, search information providers, reference agencies (such as companies that provide credit scores), as well as from publicly available sources such as social media where such Personal Data is proportionate to the position for which you are applying.  

4. Why We Process Your Personal Data  

Personal Data collected through the recruitment process is necessary to enable us to assess your suitability for employment with the Company and to manage the Company’s recruitment related activities. The Company may also use your Personal Data to set up and conduct interviews, tests, evaluations, assessments and otherwise as needed in the recruitment process, including for issuance of employment offers, if applicable. 

The processing of legal data or criminal records will be undertaken in compliance with applicable laws and in specific circumstances (e.g., for candidates for positions in the Finance Department), where required or permitted by applicable laws, legislations and policies.  

If you do not wish to provide some or all Personal Data requested, it may affect our ability to process your application, and the recruitment process may come to a halt. 

5. With Whom Do We Share Your Personal Data? 

Your Personal Data may be shared with affiliated companies within the Group, including those located outside of Brunei where the business is operated, where it is reasonable and necessary to do so. Within the Company, your Personal Data can be accessed by or may be disclosed internally on a need-to-know basis to persons responsible for managing or making hiring decisions, HR staff, system administrators and other support teams (such as IT and Finance). 

Your Personal Data may also be accessed by third parties who provide us with services relevant to your recruitment, namely recruiters, companies that host, support and/or maintain the IT systems or applications supporting our recruitment and other HR systems, such as SuccessFactors, and companies that verify your references, undertake background checks or conduct vetting on our behalf. 

If your application is successful and you accept the offer of employment with the Company, your Personal Data may also be shared with HR for administrative purposes including adding such Personal Data onto our payroll and benefits systems. Personal Data that is inserted into such systems may be accessible by providers of those systems, their affiliated companies and sub-contractors, tax authorities, regulatory authorities, solicitors, auditors, investors, consultants and other professional advisors.  

The Company expects all third parties to process any Personal Data disclosed to them in accordance with contract terms, and applicable laws and legislation. Where these third parties act as a "data processor" (for example, by verifying your references at our request), they carry out their tasks on our behalf and upon our instructions for the purposes stipulated within this Notice. In this case, your Personal Data will only be disclosed to these parties to the extent necessary to provide the required services. The Company will not disclose your Personal Data to unauthorized third parties without your express consent.  

6. Data Transfers Outside of Brunei 

In the event Personal Data is required to be shared outside of Brunei, such Personal Data shall be shared to personnel identified within this Notice and processed for purpose stipulated within this Notice only. Personal Data shared outside of the jurisdiction shall be given adequate level of protection as required). 

7. Data Retention 

The Company shall retain your Personal Data for two (2) years from the date such Personal Data is collected so you may be considered for future job openings within the Group. If you wish for the Company to remove your Personal Data after an unsuccessful application, you may provide such notice to us in writing.  

If you accept employment with Company, your Personal Data will be held on the basis set out in our Personal Data Information Notice, which is provided to all employees and that you will be required to acknowledge that you have read. As required under applicable laws and legislation, Personal Data shall be stored for a period of up to seven (7) years after you have ended your employment from the Company.  

The Company also reserves the right to retain Personal Data for exercising or defending legal claims, for a period of time corresponding to the applicable statute of limitations, or legal or regulatory obligations. 

8. Your Rights 

1. Right to Access - you have the right to request access to any of your Personal Data that the Company may hold, and to obtain information about the processing of that data.
2. Right to Correct - the Company will take steps in accordance with applicable legislation to keep your Personal Data accurate, complete and up to date. You are entitled to have any inadequate, incomplete or incorrect Personal Data corrected or rectified. You also have a responsibility to ensure that changes in personal circumstances are notified to the Company so that we can ensure that your Personal Data is up to date. 
3. Right to Withdraw Consent - in the event your Personal Data is processed on the basis of your consent, you have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.  
4. Data Portability – under certain circumstances, you have the right to receive all such Personal Data which you have provided to the Company in a structured, commonly used and machine-readable format, and also to require us to transmit it to another data user where this is technically feasible. 
5. You also have the right to lodge a complaint with the supervisory authority of your habitual residence, place of work or place of alleged infringement, if you consider that the processing of your Personal Data infringes applicable law.

2. Data Peribadi Yang Kami Kumpul 

Kami mungkin mengumpul dan memproses pelbagai jenis data peribadi yang berkaitan dengan anda seperti berikut: 

1. Data mengenai anda: nama pertama dan nama keluarga, jantina, kewarganegaraan, status perkahwinan, tarikh lahir, umur, butiran hubungan rumah (contohnya, alamat, nombor telefon, e-mel), butiran hubungan kecemasan (nama dan nombor telefon), nombor ID nasional atau nombor pasport, data imigresen dan kelayakan untuk bekerja, maklumat hubungan waris/tanggungan. 
2. Data mengenai sejarah pekerjaan dan kelayakan anda: rekod pendidikan, kelayakan profesional, rujukan. 
3. Data mengenai permohonan anda: CV dan permohonan, data temu duga, rakaman audio dan video temu duga, pengesahan rujukan. 
4. Data rekod undang-undang dan jenayah: mengikut undang-undang yang terpakai dan/atau untuk keadaan tertentu (contohnya, untuk calon jawatan di Jabatan Kewangan).

Yang di atas akan dirujuk secara kolektif sebagai “Data Peribadi”. 

3. Cara Kami Mengumpul Data Peribadi Anda 

Data Peribadi dikumpul melalui proses pengambilan, sama ada secara langsung daripada permohonan anda atau komunikasi lisan dan/atau bertulis selanjutnya, seperti proses temu duga dengan HR dan/atau pengurus pengambilan. 

Data Peribadi juga boleh dikumpul daripada pihak ketiga seperti pekerja lain, perekrut, rujukan daripada tempat pekerjaan anda yang terdahulu, rakan perniagaan, sub-kontraktor yang menyediakan perkhidmatan pengambilan atau teknikal, penyedia analitik (seperti syarikat yang mengukur kerjaya profesional), penyedia semakan latar belakang, penyedia maklumat carian, agensi rujukan (seperti syarikat yang menyediakan skor kredit), serta daripada sumber yang tersedia secara umum seperti media sosial di mana Data Peribadi tersebut adalah berkaitan dengan jawatan yang anda mohon. 

4. Mengapa Kami Memproses Data Peribadi Anda 

Data Peribadi yang dikumpul melalui proses pengambilan adalah perlu untuk membolehkan kami menilai kesesuaian anda untuk pekerjaan dengan Syarikat dan untuk menguruskan aktiviti berkaitan pengambilan Syarikat. Syarikat juga boleh menggunakan Data Peribadi anda untuk menyediakan dan menjalankan temu duga, ujian, penilaian dan sebagainya yang diperlukan dalam proses pengambilan, termasuk untuk penerbitan tawaran pekerjaan, jika berkenaan. 

Pemprosesan data undang-undang atau rekod jenayah akan dilakukan mengikut undang-undang yang terpakai dan dalam keadaan tertentu (contohnya, untuk calon jawatan di Jabatan Kewangan), di mana diperlukan atau dibenarkan oleh undang-undang, perundangan dan polisi yang berkenaan. 

Sekiranya anda tidak ingin memberikan beberapa atau semua Data Peribadi yang diminta, ia boleh menjejaskan kemampuan kami untuk memproses permohonan anda, dan proses pengambilan mungkin dihentikan. 

5. Dengan Siapa Kami Berkongsi Data Peribadi Anda? 

Data Peribadi anda mungkin dikongsi dengan syarikat bersekutu dalam Kumpulan, termasuk yang terletak di luar Brunei di mana perniagaan dijalankan, di mana adalah munasabah dan perlu untuk berbuat demikian. Dalam Syarikat, Data Peribadi anda boleh diakses atau didedahkan secara dalaman mengikut keperluan kepada orang yang bertanggungjawab untuk mengurus atau membuat keputusan pengambilan, kakitangan HR, pentadbir sistem dan pasukan sokongan lain (seperti IT dan Kewangan). 

Data Peribadi anda juga mungkin diakses oleh pihak ketiga yang menyediakan perkhidmatan yang berkaitan dengan pengambilan anda, iaitu perekrut, syarikat yang menyediakan, menyokong dan/atau mengekalkan sistem IT atau aplikasi yang menyokong pengambilan dan sistem HR kami yang lain, seperti SuccessFactors, dan syarikat yang mengesahkan rujukan anda, menjalankan semakan latar belakang atau menjalankan semakan bagi pihak kami. 

Jika permohonan anda berjaya dan anda menerima tawaran pekerjaan dengan Syarikat, Data Peribadi anda juga boleh dikongsi dengan HR untuk tujuan pentadbiran termasuk menambah Data Peribadi tersebut ke dalam sistem penggajian dan faedah kami. Data Peribadi yang dimasukkan ke dalam sistem tersebut mungkin diakses oleh penyedia sistem tersebut, syarikat bersekutunya dan sub-kontraktor, pihak berkuasa cukai, pihak berkuasa pengawalseliaan, peguam, juruaudit, pelabur, perunding dan penasihat profesional lain. 

Syarikat mengharapkan semua pihak ketiga memproses Data Peribadi yang didedahkan kepada mereka mengikut terma kontrak, undang-undang dan perundangan yang terpakai. Di mana pihak ketiga ini bertindak sebagai "pemproses data" (contohnya, dengan mengesahkan rujukan anda atas permintaan kami), mereka menjalankan tugas mereka bagi pihak kami dan mengikut arahan kami untuk tujuan yang dinyatakan dalam Notis ini. Dalam kes ini, Data Peribadi anda hanya akan didedahkan kepada pihak-pihak ini sejauh yang perlu untuk menyediakan perkhidmatan yang diperlukan. Syarikat tidak akan mendedahkan Data Peribadi anda kepada pihak ketiga yang tidak sah tanpa kebenaran eksplisit anda..

6. Pemindahan Data Di Luar Negara Anda

Sekiranya Data Peribadi perlu dikongsi di luar Malaysia, Data Peribadi tersebut akan dikongsi dengan kakitangan yang dikenal pasti dalam Notis ini dan diproses untuk tujuan yang dinyatakan dalam Notis ini sahaja. Data Peribadi yang dikongsi di luar bidang kuasa ini akan diberikan tahap perlindungan yang mencukupi seperti yang dikehendaki dalam keperluan Akta Perlindungan Data Peribadi 2010 (PDPA). 

7. Penyimpanan Data 

Syarikat akan menyimpan Data Peribadi anda selama dua (2) tahun dari tarikh pengumpulan Data Peribadi tersebut supaya anda boleh dipertimbangkan untuk peluang pekerjaan di masa hadapan dalam Kumpulan. Sekiranya anda ingin Syarikat menghapuskan Data Peribadi anda selepas permohonan yang tidak berjaya, anda boleh memberikan notis tersebut kepada kami secara bertulis. 

Jika anda menerima pekerjaan dengan Syarikat, Data Peribadi anda akan disimpan berdasarkan Notis Maklumat Data Peribadi kami, yang diberikan kepada semua pekerja dan yang anda akan diminta untuk mengakui bahawa anda telah membacanya. Seperti yang dikehendaki oleh undang-undang dan perundangan yang terpakai, Data Peribadi akan disimpan untuk tempoh sehingga tujuh (7) tahun selepas anda berhenti bekerja dengan Syarikat. 

Syarikat juga berhak untuk menyimpan Data Peribadi untuk tujuan melaksanakan atau mempertahankan tuntutan undang-undang, untuk tempoh masa yang bersesuaian dengan had masa statut undang-undang, atau kewajipan undang-undang atau peraturan. 

8. Hak Anda

1. Hak Akses - anda berhak untuk meminta akses kepada mana-mana Data Peribadi yang dimiliki oleh    Syarikat, dan untuk mendapatkan maklumat mengenai pemprosesan data tersebut. 
2. Hak Pembetulan - Syarikat akan mengambil langkah mengikut perundangan yang terpakai untuk memastikan Data Peribadi anda tepat, lengkap dan terkini. Anda berhak untuk membetulkan Data Peribadi yang tidak memadai, tidak lengkap atau salah. Anda juga bertanggungjawab untuk memastikan bahawa perubahan dalam keadaan peribadi dimaklumkan kepada Syarikat supaya kami boleh memastikan Data Peribadi anda adalah terkini. 
3. Hak untuk Menarik Balik Persetujuan - sekiranya Data Peribadi anda diproses berdasarkan persetujuan anda, anda berhak untuk menarik balik persetujuan pada bila-bila masa, tanpa menjejaskan kesahihan pemprosesan berdasarkan persetujuan sebelum penarikan tersebut. 
4. Kebolehan Data – dalam keadaan tertentu, anda berhak untuk menerima semua Data Peribadi yang telah anda berikan kepada Syarikat dalam format yang terstruktur, biasa digunakan dan boleh dibaca oleh mesin, dan juga untuk meminta kami menghantarnya kepada pengguna data lain sekiranya ia secara teknikalnya boleh dilakukan. 
5. Anda juga berhak untuk mengemukakan aduan kepada pihak berkuasa penyeliaan di tempat kediaman biasa anda, tempat kerja atau tempat pelanggaran yang didakwa, jika anda menganggap bahawa pemprosesan Data Peribadi anda melanggar undang-undang yang terpakai.

We may also receive information which may include your Personal Data from our hiring manager, from Human Resources, and, from time to time, from our other employees (for instance, in the course of conducting an interview). 

4. Why We Process Your Personal Data  

The Personal Data requested from you during the recruitment process is required by us in order to assess your application for employment with the Company. If you do not provide some or all of this Personal Data it may affect our ability to process your application and therefore to enter into an employment agreement with you. In some cases, it may mean that we are unable to continue with your application for employment as the Company will not have the Personal Data we believe to be necessary for the effective and efficient management of the recruitment process. 

We collect the Personal Data described in Section 2 above for the purposes of managing the Company’s recruitment related activities. The Company may also use your Personal Data in relation to the evaluation and selection of applicants, including for example setting up and conducting interviews and tests, and conducting evaluations, assessments and otherwise as needed in the recruitment process, including if relevant, issuing employment offers.

5. With Whom Do We Share Your Personal Data? 

As a global organization consisting of businesses in various countries, the Company may hire for its sites, and use resources, located throughout the world. Your Personal Data may be shared with affiliated companies where it is reasonable and necessary to do so. Within the Company, your Personal Data can be accessed by or may be disclosed internally on a need-to-know basis to persons responsible for managing or making hiring decisions, Human Resources staff, system administrators and other support teams (such as IT and Finance). 

Your Personal Data may also be accessed by third parties who provide us with services relevant to your recruitment, namely recruiters; companies (notably SuccessFactors) that host, support and/or maintain the IT systems or applications supporting our recruitment and other HR systems; and companies that verify your references, undertake background checks or conduct vetting on our behalf. 

If your application for employment with the Company is successful and you accept a job offer from us, your Personal Data may also be shared with HR information, payroll and benefits systems, and the Personal Data contained in such systems may be accessible by providers of those systems, their affiliated companies and sub-contractors; tax authorities; regulatory authorities; and our lawyers, auditors, investors, consultants and other professional advisors.

From time to time your Personal Data will be transferred outside your country for the purposes described in this Notice. For example, your Personal Data may be transferred, among other purposes, to conduct the review of your application, the processing of your details and the provision of support services. 

We may share your Personal Data (i) with colleagues within the Company; (ii) with colleagues within the DKSH Group (both in the country where you are applying for a position, and in other countries in which the group has operations (including countries outside your country); and (iii) with third parties as described in this Notice.   

In case of transfers outside your country, we will ensure appropriate safeguards, such as Standard Contractual Clauses, Binding Corporate Rules, or other legally acceptable mechanisms that ensure an adequate level of protection.  

7. Data Retention 

Our general approach is to retain candidate Personal Data for one year from completion of the last vacancy you applied for, to the extent you were a suitable candidate for the vacancy, so that we may consider you for future job openings, unless you expressly object. In all cases, we will retain your Personal Data for exercising or defending legal claims, for a period of time corresponding to the applicable statute of limitations, or legal or regulatory obligations.

• Data Portability - where we are relying (as the legal basis for processing) upon your consent, or the fact that the processing is necessary to perform a contract to which you are party or to take steps at your request prior to entering a contract, and the Personal Data is processed by automatic means, you have the right to receive all such Personal Data which you have provided to the Company in a structured, commonly used and machine-readable format, and also to require us to transmit it to another controller where this is technically feasible. 
• Right to Erasure - you are entitled to have your Personal Data erased under specific circumstances, such as where you have withdrawn your consent, where you object to processing based on legitimate interests and we have no overriding legitimate grounds (see below) or where Personal Data is unlawfully processed.

We may collect and process various types of personal data related to you such as the following:- 

1. Data about you: forename and surname, gender, nationality, civil/marital status, date of birth, age, home contact details (e.g., address, telephone number, e-mail), emergency contact details (name and telephone number) national ID number or passport number, immigration and eligibility to work data, next-of-kin/dependent contact information.

3. How We Collect Your Personal Data 

Personal Data is collected through the recruitment process, either directly from your application or further verbal and/or written communication, such as the interview process with HR and/or hiring manager.  

Personal Data may also be collected from third parties such as other employees, recruiters, references from your previous place of employment, business partners, sub-contractors providing recruiting or technical services, analytics providers (such as companies that benchmark professional careers), background check providers, search information providers, reference agencies (such as companies that provide credit scores), as well as from publicly available sources such as social media where such Personal Data is proportionate to the position for which you are applying.   

4. Why We Process Your Personal Data  

Personal Data collected through the recruitment process is necessary to enable us to assess your suitability for employment with the Company and to manage the Company's recruitment related activities. The Company may also use your Personal Data to set up and conduct interviews, tests, evaluations, assessments and otherwise as needed in the recruitment process, including for issuance of employment offers, if applicable. 

The processing of legal data or criminal records will be undertaken in compliance with applicable laws and in specific circumstances (e.g., for candidates for positions in the Finance Department), where required or permitted by applicable laws, legislations and policies.

5. With Whom Do We Share Your Personal Data? 

Your Personal Data may be shared with affiliated companies within the Group, including those located outside of Malaysia where the business is operated, where it is reasonable and necessary to do so. Within the Company, your Personal Data can be accessed by or may be disclosed internally on a need-to-know basis to persons responsible for managing or making hiring decisions, HR staff, system administrators and other support teams (such as IT and Finance). 

Your Personal Data may also be accessed by third parties who provide us with services relevant to your recruitment, namely recruiters, companies that host, support and/or maintain the IT systems or applications supporting our recruitment and other HR systems, such as SuccessFactors, and companies that verify your references, undertake background checks or conduct vetting on our behalf. 

If your application is successful and you accept the offer of employment with the Company, your Personal Data may also be shared with HR for administrative purposes including adding such Personal Data onto our payroll and benefits systems. Personal Data that is inserted into such systems may be accessible by providers of those systems, their affiliated companies and sub-contractors, tax authorities, regulatory authorities, solicitors, auditors, investors, consultants and other professional advisors.  

The Company expects all third parties to process any Personal Data disclosed to them in accordance with contract terms, and applicable laws and legislation. Where these third parties act as a "data processor" (for example, by verifying your references at our request), they carry out their tasks on our behalf and upon our instructions for the purposes stipulated within this Notice. In this case, your Personal Data will only be disclosed to these parties to the extent necessary to provide the required services. The Company will not disclose your Personal Data to unauthorized third parties without your express consent.

6. Data Transfers Outside of Malaysia 

In the event Personal Data is required to be shared outside of Malaysia, such Personal Data shall be shared to personnel identified within this Notice and processed for purpose stipulated within this Notice only. Personal Data shared outside of the jurisdiction shall be given adequate level of protection as required within the requirements of the Personal Data Protection Act 2010 (PDPA). 

7. Data Retention 

The Company shall retain your Personal Data for two (2) years from the date such Personal Data is collected so you may be considered for future job openings within the Group. If you wish for the Company to remove your Personal Data after an unsuccessful application, you may provide such notice to us in writing.  

If you accept employment with Company, your Personal Data will be held on the basis set out in our Personal Data Information Notice, which is provided to all employees and that you will be required to acknowledge that you have read. As required under applicable laws and legislation, Personal Data shall be stored for a period of up to seven (7) years after you have ended your employment from the Company.  

The Company also reserves the right to retain Personal Data for exercising or defending legal claims, for a period of time corresponding to the applicable statute of limitations, or legal or regulatory obligations. 

8. Your Rights 

1. Right to Access - you have the right to request access to any of your Personal Data that the Company may hold, and to obtain information about the processing of that data.   
2. Right to Correct - the Company will take steps in accordance with applicable legislation to keep your Personal Data accurate, complete and up to date. You are entitled to have any inadequate, incomplete or incorrect Personal Data corrected or rectified. You also have a responsibility to ensure that changes in personal circumstances are notified to the Company so that we can ensure that your Personal Data is up to date.

3. Cara Kami Mengumpul Data Peribadi Anda

Jika permohonan anda berjaya dan anda menerima tawaran pekerjaan dengan Syarikat, Data Peribadi anda juga boleh dikongsi dengan HR untuk tujuan pentadbiran termasuk menambah Data Peribadi tersebut ke dalam sistem penggajian dan faedah kami. Data Peribadi yang dimasukkan ke dalam sistem tersebut mungkin diakses oleh penyedia sistem tersebut, syarikat bersekutunya dan sub-kontraktor, pihak berkuasa cukai, pihak berkuasa pengawalseliaan, peguam, juruaudit, pelabur, perunding dan penasihat profesional lain. 

Syarikat mengharapkan semua pihak ketiga memproses Data Peribadi yang didedahkan kepada mereka mengikut terma kontrak, undang-undang dan perundangan yang terpakai. Di mana pihak ketiga ini bertindak sebagai "pemproses data" (contohnya, dengan mengesahkan rujukan anda atas permintaan kami), mereka menjalankan tugas mereka bagi pihak kami dan mengikut arahan kami untuk tujuan yang dinyatakan dalam Notis ini. Dalam kes ini, Data Peribadi anda hanya akan didedahkan kepada pihak-pihak ini sejauh yang perlu untuk menyediakan perkhidmatan yang diperlukan. Syarikat tidak akan mendedahkan Data Peribadi anda kepada pihak ketiga yang tidak sah tanpa kebenaran eksplisit anda. 

6. Pemindahan Data Di Luar Negara Anda 

Sekiranya Data Peribadi perlu dikongsi di luar Malaysia, Data Peribadi tersebut akan dikongsi dengan kakitangan yang dikenal pasti dalam Notis ini dan diproses untuk tujuan yang dinyatakan dalam Notis ini sahaja. Data Peribadi yang dikongsi di luar bidang kuasa ini akan diberikan tahap perlindungan yang mencukupi seperti yang dikehendaki dalam keperluan Akta Perlindungan Data Peribadi 2010 (PDPA). 

7. Penyimpanan Data 

Syarikat akan menyimpan Data Peribadi anda selama dua (2) tahun dari tarikh pengumpulan Data Peribadi tersebut supaya anda boleh dipertimbangkan untuk peluang pekerjaan di masa hadapan dalam Kumpulan. Sekiranya anda ingin Syarikat menghapuskan Data Peribadi anda selepas permohonan yang tidak berjaya, anda boleh memberikan notis tersebut kepada kami secara bertulis. 

Jika anda menerima pekerjaan dengan Syarikat, Data Peribadi anda akan disimpan berdasarkan Notis Maklumat Data Peribadi kami, yang diberikan kepada semua pekerja dan yang anda akan diminta untuk mengakui bahawa anda telah membacanya. Seperti yang dikehendaki oleh undang-undang dan perundangan yang terpakai, Data Peribadi akan disimpan untuk tempoh sehingga tujuh (7) tahun selepas anda berhenti bekerja dengan Syarikat. 

Syarikat juga berhak untuk menyimpan Data Peribadi untuk tujuan melaksanakan atau mempertahankan tuntutan undang-undang, untuk tempoh masa yang bersesuaian dengan had masa statut undang-undang, atau kewajipan undang-undang atau peraturan. 

8. Hak Anda 

1. Hak Akses - anda berhak untuk meminta akses kepada mana-mana Data Peribadi yang dimiliki oleh Syarikat, dan untuk mendapatkan maklumat mengenai pemprosesan data tersebut. 
2. Hak Pembetulan - Syarikat akan mengambil langkah mengikut perundangan yang terpakai untuk memastikan Data Peribadi anda tepat, lengkap dan terkini. Anda berhak untuk membetulkan Data Peribadi yang tidak memadai, tidak lengkap atau salah. Anda juga bertanggungjawab untuk memastikan bahawa perubahan dalam keadaan peribadi dimaklumkan kepada Syarikat supaya kami boleh memastikan Data Peribadi anda adalah terkini. 
3. Hak untuk Menarik Balik Persetujuan - sekiranya Data Peribadi anda diproses berdasarkan persetujuan anda, anda berhak untuk menarik balik persetujuan pada bila-bila masa, tanpa menjejaskan kesahihan pemprosesan berdasarkan persetujuan sebelum penarikan tersebut. 
4. Kebolehan Data – dalam keadaan tertentu, anda berhak untuk menerima semua Data Peribadi yang telah anda berikan kepada Syarikat dalam format yang terstruktur, biasa digunakan dan boleh dibaca oleh mesin, dan juga untuk meminta kami menghantarnya kepada pengguna data lain sekiranya ia secara teknikalnya boleh dilakukan.

4. Why We Process Your Personal Data and Legal Basis for Processing 

The Personal Data requested from you during the recruitment process is required by us in order to assess your application for employment with DKSH. If you do not provide some or all of this Personal Data it may affect our ability to process your application and therefore to enter into an employment agreement with you. In some cases, it may mean that we are unable to continue with your application for employment as DKSH will not have the Personal Data we believe to be necessary for the effective and efficient management of the recruitment process.

The processing of legal or criminal records data will be undertaken in compliance with applicable laws and in specific circumstances (e.g., for candidates for positions in the Finance Department), where required or permitted by the applicable laws, national collecting bargaining agreements or binding resolutions of the relevant Data Protection Authority. The legal basis for such processing will be necessity for compliance with a legal obligation, and/ or DKSH’s legitimate interests in hiring, for roles involving the regular handling of significant assets, persons who have proven their reliability and probity and/or your explicit consent, as applicable and required by local laws. 

If You provide us with Personal Data of other individuals (e.g., emergency contacts), You confirm that you have obtained their consent to share their information with us for the purpose outlined in this Notice.  

5. With Whom Do We Share Your Personal Data? 

As a global organization consisting of businesses in various countries, DKSH may hire for its sites, and use resources, located throughout the world. Your Personal Data may be shared with affiliated companies where it is reasonable and necessary to do so. Within DKSH, your Personal Data can be accessed by or may be disclosed internally on a need-to-know basis to persons responsible for managing or making hiring decisions, Human Resources staff, system administrators and other support teams (such as IT and Finance). 

Your Personal Data may also be accessed by third parties who provide us with services relevant to your recruitment, namely recruiters; companies (notably SuccessFactors) that host, support and/or maintain the IT systems or applications supporting our recruitment and other HR systems; and companies that verify your references, undertake background checks or conduct vetting on our behalf. 

If your application for employment with DKSH is successful and you accept a job offer from us, your Personal Data may also be shared with HR information, payroll and benefits systems, and the Personal Data contained in such systems may be accessible by providers of those systems, their affiliated companies and sub-contractors; tax authorities; regulatory authorities; and our lawyers, auditors, investors, consultants and other professional advisors.  

DKSH expects all third parties to process any Personal Data disclosed to them in accordance with applicable law and contract terms, including with respect to Personal Data confidentiality and security. Where these third parties act as a "data processor" (for example, by verifying your references at our request), they carry out their tasks on our behalf and upon our instructions for the above mentioned purposes. In this case, your Personal Data will only be disclosed to these parties to the extent necessary to provide the required services.  

DKSH will not disclose your Personal Data to unauthorized third parties.  

6. Data Transfers Outside your country 

From time to time your Personal Data will be transferred outside your country for the purposes described in this Notice. For example, your Personal Data may be transferred, among other purposes, to conduct the review of your application, the processing of your details and the provision of support services. 

We may share your Personal Data (i) with colleagues within DKSH; (ii) with colleagues within the DKSH Group (both in the country where you are applying for a position, and in other countries in which the group has operations (including countries outside your country); and (iii) with third parties as described in this Notice.   

We will provide you upon your request a list of the countries located outside your country to which your Personal Data may be transferred, and an indication of whether they have been determined  to grant adequate protection to Personal Data. Please send your request as indicated in How to Exercise Your Rights below.  

In case of transfers outside your country, we will ensure appropriate safeguards, such as  Standard Contractual Clauses, Binding Corporate Rules, or other legally acceptable mechanisms that ensure an adequate level of protection. Where applicable, you are entitled to receive a copy of the relevant contract (such as Standard Contractual Clauses or Binding Corporate Rules) showing that appropriate safeguards have been taken to protect your Personal Data in connection with such transfer. Please send your request as indicated in How to Exercise Your Rights below. 

Transfers of Personal Data are based on the same legal basis as applicable for the respective purposes of processing as set forth in Section 4 above.  

7. Data Retention 

Our general approach is to retain candidate Personal Data for one year from completion of the last vacancy you applied for, to the extent you were a suitable candidate for the vacancy, so that we may consider you for future job openings, unless you expressly object. In all cases, we will retain your Personal Data for exercising or defending legal claims, for a period of time corresponding to the applicable statute of limitations, or legal or regulatory obligations. 

If you accept employment with DKSH, your Personal Data will be held on the basis set out in our Employee Privacy Notice, which is provided to all employees and that you will be required to acknowledge that you have read. 

8. Your Rights 

• Right to Access - you have the right to request access to any of your Personal Data that DKSH may hold, and to obtain information about the processing of that data.    
• Right to Correct - DKSH will take steps in accordance with applicable legislation to keep your Personal Data accurate, complete and up-to-date. You are entitled to have any inadequate, incomplete or incorrect Personal Data corrected (that is, rectified). You also have a responsibility to ensure that changes in personal circumstances are notified to DKSH so that we can ensure that your Personal Data is up-to-date. 
• Right to Withdraw Consent - in the event your Personal Data is processed on the basis of your consent, you have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.  
• Data Portability - where we are relying (as the legal basis for processing) upon your consent, or the fact that the processing is necessary to perform a contract to which you are party or to take steps at your request prior to entering a contract, and the Personal Data is processed by automatic means, you have the right to receive all such Personal Data which you have provided to DKSH in a structured, commonly used and machine-readable format, and also to require us to transmit it to another controller where this is technically feasible. 
• Right to Erasure - you are entitled to have your Personal Data erased under specific circumstances, such as where you have withdrawn your consent, where you object to processing based on legitimate interests and we have no overriding legitimate grounds (see below) or where Personal Data is unlawfully processed. 
• Right to Restriction of Processing - you have the right to restrict our processing of your Personal Data (that is, allow only its storage) where:  
  • you contest the accuracy of the Personal Data, until we have taken sufficient steps to correct or verify its accuracy;  
  • the processing is unlawful but you do not want us to erase the Personal Data; 
  • we no longer need your Personal Data for the purposes of the processing, but you require such Personal Data for the establishment, exercise or defence of legal claims; or  
  • you have objected to processing justified on legitimate interest grounds (see below), pending verification as to whether DKSH has compelling legitimate grounds to continue processing. 
  • Where your Personal Data is subject to restriction we will only process it with your consent or for the establishment, exercise or defence of legal claims. 
• Right to Object to Processing Justified on Legitimate Interest Grounds - where we are relying upon our legitimate interests to process Personal Data, you have the right to object to that processing.  If you object, we must stop that processing unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or we need to process the Personal Data for the establishment, exercise or defence of legal claims. Where we rely upon legitimate interest as a basis for processing, we believe that we can demonstrate such compelling legitimate grounds, but we will consider each case on an individual basis. 
• You also have the right to lodge a complaint with the supervisory authority of your habitual residence, place of work or place of alleged infringement, if you consider that the processing of your Personal Data infringes applicable law.

တရားဝင်တည်ရှိမှုနှင့် ရာဇဝတ်မှုဆိုင်ရာမှတ်တမ်းများကို ကိုင်တွယ်လုပ်ဆောင်ရာတွင် သက်ဆိုင်ရာဥပဒေများနှင့်အညီ လိုက်နာပြီး အထူးအခြေအနေများတွင် (ဥပမာ - ဘဏ္ဍာရေးဌာနတွင် အလုပ်အကိုင်လျှောက်ထားသူများအတွက်) သက်ဆိုင်ရာဥပဒေများအရ လိုအပ်သည့် အတိုင်းအတာအထိ သို့မဟုတ် ခွင့်ပြုသည်အထိ အလုပ်သမားရေးရာကိစ္စရပ်များအတွက် လိုအပ်သလိုစာချုပ်ချူပ်ဆိုခြင်း သို့မဟုတ် သက်ဆိုင်ရာ ကိုယ်ရေးကိုယ်တာအချက်အလက် ကာကွယ်ရေးအတွက် အာဏာပိုင်များ၏ထုတ်ပြန်ချက် စည်းမျဉ်းများနှင့် အညီ စာချုပ်ချူပ်ဆိုခြင်းများကို ပြုလုပ်ပါမည်။ ထိုသို့ ဥပဒေနှင့်အညီ လိုက်နာလုပ်ဆောင်ခြင်းများသည် ဥပဒေအရလိုက်နာရမည့် တာဝန်တစ်ခုကို လိုက်နာဆောင်ရွက်ခြင်းဖြစ်သကဲ့သို့ သို့မဟုတ် DKSH ၏ တရားဝင်အကျိုးစီးပွားများအတွက် လိုအပ်သော လုပ်ဆောင်ချက်များအတိုင်း ဆောင်ရွက် ခြင်းလည်းဖြစ်သည်။ (ဥပမာ - ပစ္စည်းဥစ္စာများကို ပုံမှန်ကိုင်တွယ်ရသော နေရာများအတွက် ယုံကြည်စိတ်ချရသူများကို ခန့်ထားရန်၊ သို့မဟုတ် သင့်ထံမှ သီးသန့်ခွင့်ပြုချက်ကို သက်ဆိုင်ရာနိုင်ငံဥပဒေများအညီ လိုအပ်သရွေ့ သို့မဟုတ် သက်ဆိုင်သရွေ့ လိုက်နာ လုပ်ဆောင်မည်ဖြစ်သည်။  

သင်သည် ကျွန်ုပ်တို့ထံ အခြားပုဂ္ဂိုလ်များ၏ ကိုယ်ရေးကိုယ်တာအချက်အလက်များ (ဥပမာ - အရေးပေါ်ဆက်သွယ်ရန်အချက်အလက်များ)ကို ပေးအပ်ပါက ဤအသိပေးချက်တွင် ဖော်ပြထားသော ရည်ရွယ်ချက်အတွက် ထိုအချက်အလက်များကို ကျွန်ုပ်တို့နှင့် မျှဝေရန် သူတို့၏ ခွင့်ပြုချက်ကို ရရှိထားကြောင်း အတည်ပြုသည်ဟု မှတ်ယူပါသည်။.  

၅။ ကျွန်ုပ်တို့ သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို မည်သူနှင့် မျှဝေသနည်း  

ကမ္ဘာတစ်ဝှမ်းရှိနိုင်ငံများတွင် လုပ်ငန်းများလုပ်ကိုင်နေသော ကမ္ဘာလုံးဆိုင်ရာအဖွဲ့အစည်းတစ်ခု ဖြစ်သည့် DKSH သည် ၎င်း၏ လစ်လပ်နေရာများတွင် ခန့်ထားရန် ကမ္ဘာတစ်ဝှမ်းရှိ အရင်းအမြစ်များကို အသုံးပြုနိုင်ပါသည်။ ကျိုးကြောင်းတိုက်ဆိုင်ပြီး လိုအပ်ပါက သင့်ကိုယ်ရေးကိုယ်တာ အချက်အလက်များကို လုပ်ငန်းခွဲများနှင့် မျှဝေနိုင်ပါသည်။ DKSH လုပ်ငန်းများအတွင်း သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို လိုအပ်သူများ၊ အလုပ်ခန့်ထားရေး ဆုံးဖြတ်ချက်များ ချမှတ်သူများ၊ လူ့စွမ်းအားအရင်းအမြစ်ဌာနမှ (HR) ဝန်ထမ်းများ၊ လုပ်ငန်းစနစ်ကို စီမံခန့်ခွဲသူများနှင့် အခြားပံ့ပိုးကူညီရေးအဖွဲ့များ (ဥပမာ - IT နှင့် ဘဏ္ဍာရေး) တို့က ဝင်ရောက်ကြည့်ရှုနိုင်ပါသည်။  

သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို သင့်အား အလုပ်အကိုင်လျှောက်ထားခြင်းဆိုင်ရာ ဝန်ဆောင်မှုများပေးသော ကြားခံနယ် (လူပုဂ္ဂိုလ်) များထံမှလည်း ဝင်ရောက်ကြည့်ရှုနိုင်ပါသည်။ ဥပမာ - အလုပ်ခန့်ထားရေးအေဂျင်စီများ၊ ကျွန်ုပ်တို့၏ အလုပ်အကိုင်လျှောက်ထားခြင်းနှင့် အခြား လူ့စွမ်းအားအရင်းအမြစ်စနစ်များကို ပံ့ပိုးပေးသော ကုမ္ပဏီများ (ဥပမာ - Success Factors)၊ သင့်ကိုးကားချက်များကို စစ်ဆေးပေးသော ကုမ္ပဏီများ၊ နောက်ခံစစ်ဆေးမှုများ သို့မဟုတ် ကျွန်ုပ်တို့အတွက် စစ်ဆေးစိစစ်မှု ပြုလုပ်ပေးသော ကုမ္ပဏီများ။

DKSHသည် ကြားခံအဖွဲ့အစည်း(လူပုဂ္ဂိုလ်)တို့ထံ ပေးအပ်ထားသော ကိုယ်ရေးကိုယ်တာ အချက်အလက်များကို သက်ဆိုင်ရာဥပဒေများ၊ စာချုပ်စည်းမျဉ်းများနှင့်အညီ စီမံဆောင်ရွက်ထားပါသည်။ ဥပမာ - ကိုယ်ရေးကိုယ်တာအချက်အလက်များ၏ လျှို့ဝှက်မှုနှင့် လုံခြုံမှုဆိုင်ရာစည်းမျဉ်းများ။ ထိုကြားခံအဖွဲ့အစည်း (လူပုဂ္ဂိုလ်)များသည် "အချက်အလက် ထိန်းသိမ်းသူ" အဖြစ်ဆောင်ရွက်ပါက (ဥပမာ - ကျွန်ုပ်တို့၏ တောင်းဆိုချက်အရ သင်ပေးအပ်ထားသည့် အထောက်အထားကိုးကားချက်များကို စစ်ဆေးခြင်း) တို့ကို၊ ကျွန်ုပ်တို့၏ ညွှန်ကြားချက်များအရ ကျွန်ုပ်တို့၏ကိုယ်စား လုပ်ဆောင်ပါသည်။ ဤကိစ္စတွင် လိုအပ်သော ဝန်ဆောင်မှုများကို ပေးအပ်ရန် သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို လိုအပ်သလောက်သာ ထိုသူများထံ ပေးအပ်ပါမည်။   

DKSH သည် သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို ခွင့်ပြုချက်မရှိသော ကြားခံပုဂ္ဂိုလ် (လူပုဂ္ဂိုလ်) များထံ ပေးအပ်မည်မဟုတ်ပါ။   

၆။ သင့်နိုင်ငံပြင်ပသို့ အချက်အလက်များ လွှဲပြောင်းခြင်း  

အချိန်အခါအလိုက် သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို ဤအသိပေးချက်တွင် ဖော်ပြထားသော ရည်ရွယ်ချက်များအတွက် သင့်နိုင်ငံပြင်ပသို့ လွှဲပြောင်းနိုင်ပါသည်။ ဥပမာ - သင့်လျှောက်ထားမှုကို ပြန်လည်သုံးသပ်ခြင်း၊ သင့်အချက်အလက်များကို စီမံခြင်းလုပ်ငန်းစဉ်နှင့် ပံ့ပိုးကူညီရေးဝန်ဆောင်မှုများပေးခြင်းတို့အတွက် သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို လွှဲပြောင်းနိုင်ပါသည်။  

ကျွန်ုပ်တို့သည် သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို (၁) DKSH အတွင်း လုပ်ဖော်ကိုင်ဖက်များ (၂) DKSH အုပ်စုအတွင်း လုပ်ဖော်ကိုင်ဖက်များနှင့် (သင့်အား အလုပ်အကိုင်လျှောက်ထားသော နိုင်ငံတွင် ရှိသော လုပ်ဖော်ကိုင်ဖက်များနှင့် အခြားနိုင်ငံများတွင်ရှိသော လုပ်ဖော်ကိုင်ဖက်များ (သင့်နိုင်ငံပြင်ပတွင် ရှိသော နိုင်ငံများအပါအဝင်) နှင့် (၃) ဤအသိပေးချက်တွင် ဖော်ပြထားသော တတိယပါတီများနှင့် မျှဝေနိုင်ပါသည်။    

သင့်နိုင်ငံပြင်ပရှိ နိုင်ငံများသို့ သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များ လွှဲပြောင်းနိုင်သည့် နိုင်ငံများ၏ စာရင်းနှင့် ထိုနိုင်ငံများတွင် ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို လုံခြုံစွာ ကာကွယ်ပေးနိုင်ကြောင်း သတ်မှတ်ထားခြင်း ရှိ/မရှိ တို့ကို သင့်တောင်းဆိုချက်အရ ပေးအပ်ပါမည်။ ကျေးဇူးပြု၍ သင့်တောင်းဆိုချက်ကို အောက်တွင်ဖော်ပြထားသော "သင်၏ရပိုင်ခွင့်အခွင့်အရေးများကို သုံးစွဲရမည့်နည်းလမ်းများ” ကဏ္ဍတွင် ဖော်ပြထားသော နည်းလမ်းအတိုင်း ပေးပို့ရပါမည်။   

သင့်နိုင်ငံပြင်ပသို့ အချက်အလက်များ လွှဲပြောင်းခြင်းအတွက် ကျွန်ုပ်တို့သည် သင့်လျော်သော အကာအကွယ်များလုပ်ဆောင်၍ ပေးပို့သည်မှာ သေချာစေပါမည်။ ဥပမာ - Standard Contractual Clauses၊ Binding Corporate Rules၊ သို့မဟုတ် အခြားတရားဝင်လက်ခံနိုင်သော ယန္တရားများ၊ ထိုသို့သော လွှဲပြောင်းမှုနှင့်ပတ်သက်၍ သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို ကာကွယ်ရန် သင့်လျော်သော အကာအကွယ်များ ပြုလုပ်ထားကြောင်း ပြသနိုင်သောစာချုပ် (ဥပမာ - Standard Contractual Clauses သို့မဟုတ် Binding Corporate Rules) ၏ မိတ္တူကို ရယူပိုင်ခွင့်ရှိပါသည်။  

ယ်ရေးကိုယ်တာအချက်အလက်များ လွှဲပြောင်းခြင်းသည် အထက်တွင်ဖော်ပြထားသော ရည်ရွယ်ချက်များအတွက် သက်ဆိုင်ရာလုပ်ငန်းစဉ်များအား ဥပဒေနှင့်အညီ စီမံလုပ်ဆောင်ခြင်း ဖြစ်သည်။   

၇။ အချက်အလက်များ ထိန်းသိမ်းခြင်း  

သင့်အားအနာဂတ်အလုပ်အကိုင်နေရာများတွင် ထည့်သွင်းစဉ်းစားနိုင်ရန် သာမန်အားဖြင့် ကျွန်ုပ်တို့ကျင့်သုံးလေ့ရှိသည့်ပုံစံမှာ သင့်၏ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို သင့်အနေဖြင့် နောက်ဆုံးလျှောက်ထားသော အလုပ်အကိုင်နေရာပြီးဆုံးသည့်နေ့မှ တစ်နှစ်အထိ ထိန်းသိမ်းထားရန် ဖြစ်ပါသည်။ သို့သော် သင်သည် ထပ်တလဲလဲ ကန့်ကွက်ပါက မည်သည့်ကိစ္စတွင်မဆို ကျွန်ုပ်တို့သည် သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို တရားဝင်တောင်းဆိုမှုများ သို့မဟုတ် ကာကွယ်ရန်အတွက်၊ သက်ဆိုင်ရာ တရားဝင်ကန့်သတ်ချက်များ သို့မဟုတ် တရားဝင်စည်းမျဉ်းများ နှင့်အညီ၊ သက်ဆိုင်ရာကာလအထိ ထိန်းသိမ်းထားပါမည်။  

သင့်အား DKSH တွင် အလုပ်လုပ်ကိုင်ရန်လက်ခံပါက၊ သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို ကျွန်ုပ်တို့၏ ဝန်ထမ်းကိုယ်ရေးကိုယ်တာလုံခြုံမှုအသိပေးချက်တွင် သတ်မှတ်ဖော်ပြထားသော အခြေခံအချက်များနှင့်အညီ ထိန်းသိမ်းထားပါမည်။ ထိုအသိပေးချက်ကို ဝန်ထမ်းအားလုံးအား ပေးအပ်ထားပြီး သင်သည် ထိုအသိပေးချက်ကို ဖတ်ရှုပြီးကြောင်း အသိအမှတ်ပြုရန် လိုအပ်ပါသည်။  

၈။ သင်၏ရပိုင်ခွင့်အခွင့်အရေးများ  

• အချက်အလက်များကို ဝင်ရောက်ကြည့်ရှုခွင့် - သင့်အနေဖြင့် DKSH ထံတွင် ရှိနိုင်သော သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို ဝင်ရောက်ကြည့်ရှုရန် တောင်းဆိုနိုင်ပြီး ထိုအချက်အလက်များ စီမံဆောင်ရွက်ခြင်းနှင့်ပတ်သက်သော အချက်အလက်များကို ရယူနိုင်ပါသည်။     
• အချက်အလက်များကို ပြင်ဆင်ခွင့် - DKSH သည် သက်ဆိုင်ရာဥပဒေများနှင့်အညီ သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို တိကျပြည့်စုံစေရန်နှင့် နောက်ဆုံးပေါ်ဖြစ်စေရန် လုပ်ဆောင်ပါမည်။ သင့်အနေဖြင့် မလုံလောက်သော၊ မပြည့်စုံသော သို့မဟုတ် မှားယွင်းသော ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို ပြင်ဆင်ရန် အခွင့်အရေးရှိပါသည်။ ထို့အပြင် သင့်အနေဖြင့် ကိုယ်ရေးကိုယ်တာအခြေအနေများ ပြောင်းလဲပါက DKSH သို့ အကြောင်းကြားရန် တာဝန်ရှိပါသည်။ သို့မှသာ သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို နောက်ဆုံးရအချက်အလက် (update) ဖြစ်စေနိုင်ပါမည်။  
• ခွင့်ပြုချက်ကို ရုပ်သိမ်းခွင့် - သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို သင့်ခွင့်ပြုချက်အပေါ် အခြေခံ၍ စီမံဆောင်ရွက်ပါက သင့်အနေဖြင့် မည်သည့်အချိန်တွင်မဆို ခွင့်ပြုချက်ကို ရုပ်သိမ်းနိုင်ပါသည်။ ထိုသို့ပြုလုပ်ခြင်းသည် ခွင့်ပြုချက်ရုပ်သိမ်းခြင်းမတိုင်မီ စီမံခြင်းလုပ်ငန်းစဉ်၏ တရားဝင်မှုကို မထိခိုက်စေပါ။   
• အချက်အလက်များ လွှဲပြောင်းနိုင်ခွင့် - ကျွန်ုပ်တို့သည် သင့်ခွင့်ပြုချက်ကို အခြေခံ၍ ဥပဒေနှင့်အညီ ဝန်ထမ်းရွေးချယ်ခန့်ထားခြင်း လုပ်ငန်းစဉ်လုပ်ဆောင်ရာတွင် သို့မဟုတ် သင်၏သဘောဆန္ဒနှင့်အညီ သင့်နှင့်စာချုပ်ချုပ်ဆိုခြင်းမပြုမီ သင့်၏တောင်းဆိုချက်အရ လုပ်ဆောင်ရန် သို့မဟုတ် စာချုပ်ဝင်အဖြစ် ပါဝင်ဆောင်ရွက်ရန်နှင့် သင့်ကိုယ်ရေးကိုယ်တာ အချက်အလက်များအရ ဝန်ထမ်းခန့်ထားခြင်းကို အလိုအလျောက်လုပ်ဆောင်စေခြင်းကိုအခြေခံ၍ ကိုင်တွယ်ပါက သင့်အနေဖြင့် DKSH ထံပေးအပ်ထားသော သင်၏ ကိုယ်ရေးကိုယ်တာ အချက်အလက်များအားလုံးကို စနစ်တကျဖွဲ့စည်း ထားသော၊ သာမန်အသုံးပြုနိုင်သည့်အပြင် စက်ဖြင့်ဖတ်နိုင်သောပုံစံတို့ဖြင့် ရယူနိုင်ပါသည်။ ထို့အပြင် ထိုသို့ပြုလုပ်ရန် နည်းပညာဆိုင်ရာ အခွင့်အလမ်းရှိပါက ကျွန်ုပ်တို့အား ထိုအချက်အလက်များကို အခြားထိန်းသိမ်းဆောင်ရွက်သူထံ ပေးပို့ရန် တောင်းဆိုနိုင်ပါသည်။  
• အချက်အလက်များကို ဖျက်သိမ်းခွင့် - သင့်အနေဖြင့် သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို အောက်တွင်ဖော်ပြထားသော အခြေအနေတစ်ရပ်ရပ်တွင် ဖျက်သိမ်းရန် အခွင့်အရေးရှိပါသည်၊ ဥပမာ - သင့်ခွင့်ပြုချက်ကို ရုပ်သိမ်းပါက၊ ကျွန်ုပ်တို့၏ တရားဝင်အကျိုးစီးပွားများကို အခြေခံ၍ စီမံဆောင်ရွက်ခြင်းကို ကန့်ကွက်ပါက နှင့် ကျွန်ုပ်တို့တွင် ထိုသို့သော စီမံဆောင်ရွက်ခြင်းကို ဆက်လက်ပြုလုပ်ရန် မရှိပါက သို့မဟုတ် ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို တရားမဝင်စွာ စီမံဆောင်ရွက်ပါက စသည်တို့ ဖြစ်ပါသည်။   
  • သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များ၏ တိကျမှုကို သံသယရှိပါက ကျွန်ုပ်တို့အနေဖြင့် ထိုအချက်အလက်များ၏ တိကျမှုကို ပြင်ဆင်ရန် သို့မဟုတ် စစ်ဆေးရန် လုံလောက်သော အဆင့်များကို မပြုလုပ်မခြင်း ဖြစ်လျင် ;  
  • မံဆောင်ရွက်ခြင်းသည် တရားမဝင်သော်လည်း သင့်အနေဖြင့် ထိုကိုယ်ရေးကိုယ်တာ အချက်အလက်များကို ဖျက်သိမ်းရန် မလိုလားသော အခြေအနေ ဖြစ်လျင်   
  • ကျွန်ုပ်တို့အနေဖြင့် သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို ဆက်လက် ဆောင်ရွက်ရန် မလိုအပ်သော်လည်း သင့်အနေဖြင့် ထိုအချက်အလက်များကို ဥပဒေအရ ကာကွယ်ရန်၊ ခုခံရန် သို့မဟုတ် တည်ဆောက်ရန် အတွက် လိုအပ်သော အခြေအနေ ဖြစ်လျင်  
  • သင့်အနေဖြင့် တရားဝင်အကျိုးစီးပွားအပေါ်အခြေခံသည့် လုပ်ငန်းစဉ် (အောက်တွင်ကြည့်ပါ) ကို ကန့်ကွက်ခဲ့ပြီး DKSH တွင် ဆက်လက်လုပ်ဆောင်ရန် တရားဝင်အကျိုးစီးပွားဆိုင်ရာ စည်းမျဉ်းများ ရှိ/မရှိ အတည်ပြုခြင်း၊ စစ်ဆေးဆဲဖြစ်ခြင်း၊ သင့်ကိုယ်ရေးကိုယ်တာအချက်အလက်များကို ကန့်သတ်ခံရချိန်တွင် ကျွန်ုပ်တို့ အနေဖြင့် သင့် ကိုယ်ပိုင်ခွင့်ပြုချက်ရရှိမှသာ သို့မဟုတ် ထိုအချက်အလက်များကို ဥပဒေအရ ကာကွယ်ရန်၊ ခုခံရန် သို့မဟုတ် တည်ဆောက်ရန် အတွက် လိုအပ်သော အခြေအနေ ဖြစ်လျင် အစရှိသော အခြေအနေ များတွင် ဖြစ်ပါသည်။

2. Personal Data We Collect 

We may collect and process various types of Personal Data about you for the purposes described in this Notice, including: 

• Data about you: forename and surname, gender, nationality, civil/marital status, date of birth, age, home contact details (e.g., address, telephone number, e-mail), emergency contact details (name and telephone number) national ID number, immigration and eligibility to work data, next-of-kin/dependent contact information  
• Data about your employment history and qualifications: qualifications, references 
• Data about your application: CV and application, interview data, audio and video recordings of interviews, verification of references  
• Legal and criminal records data: in compliance with the applicable laws and in specific circumstances (e.g., for candidates for positions in the Finance Department)]

3. How We Collect Your Data 

You may give us the Personal Data described above during the recruitment process, whether through your application, further communications, on the telephone or at interviews.  

We may also receive or obtain Personal Data about you from third parties; for example, recruiters; references from a previous employer; business partners; sub-contractors providing recruiting or technical services; analytics providers (such as companies that benchmark professional careers); background check providers; search information providers; and reference agencies (such as companies that provide credit scores), as well as from publicly available sources such as social media where such Personal Data is proportionate to the position for which you are applying.  We may also retain that Personal Data after you have been employed (where this is relevant and to the extent permitted by applicable law). 

We may also receive information which may include your Personal Data from our hiring manager, from Human Resources, and, from time to time, from our other employees (for instance, in the course of conducting an interview). 

4. Why We Process Your Personal Data  

The Personal Data requested from you during the recruitment process is required by us in order to assess your application for employment with the Company. If you do not provide some or all of this Personal Data it may affect our ability to process your application and therefore to enter into an employment agreement with you. In some cases, it may mean that we are unable to continue with your application for employment as the Company will not have the Personal Data we believe to be necessary for the effective and efficient management of the recruitment process. 

We collect the Personal Data described in Section 2 above for the purposes of managing the Company’s recruitment related activities. The Company may also use your Personal Data in relation to the evaluation and selection of applicants, including for example setting up and conducting interviews and tests, and conducting evaluations, assessments and otherwise as needed in the recruitment process, including if relevant, issuing employment offers.  

The processing of legal or criminal records data will be undertaken in compliance with applicable laws and in specific circumstances (e.g., for candidates for positions in the Finance Department), where required or permitted by the applicable laws, national collecting bargaining agreements or binding resolutions of the relevant Data Protection Authority.  

5. With Whom Do We Share Your Personal Data? 

As a global organization consisting of businesses in various countries, the Company may hire for its sites, and use resources, located throughout the world. Your Personal Data may be shared with affiliated companies where it is reasonable and necessary to do so. Within the Company, your Personal Data can be accessed by or may be disclosed internally on a need-to-know basis to persons responsible for managing or making hiring decisions, Human Resources staff, system administrators and other support teams (such as IT and Finance). 

Your Personal Data may also be accessed by third parties who provide us with services relevant to your recruitment, namely recruiters; companies (notably SuccessFactors) that host, support and/or maintain the IT systems or applications supporting our recruitment and other HR systems; and companies that verify your references, undertake background checks or conduct vetting on our behalf. 

If your application for employment with the Company is successful and you accept a job offer from us, your Personal Data may also be shared with HR information, payroll and benefits systems, and the Personal Data contained in such systems may be accessible by providers of those systems, their affiliated companies and sub-contractors; tax authorities; regulatory authorities; and our lawyers, auditors, investors, consultants and other professional advisors.  

The Company expects all third parties to process any Personal Data disclosed to them in accordance with applicable law and contract terms, including with respect to Personal Data confidentiality and security. Where these third parties act as a "data processor" (for example, by verifying your references at our request), they carry out their tasks on our behalf and upon our instructions for the above mentioned purposes. In this case, your Personal Data will only be disclosed to these parties to the extent necessary to provide the required services.  

The Company will not disclose your Personal Data to unauthorized third parties.  

6. Data Transfers Outside your country 

From time to time your Personal Data will be transferred outside your country for the purposes described in this Notice. For example, your Personal Data may be transferred, among other purposes, to conduct the review of your application, the processing of your details and the provision of support services. 

We may share your Personal Data (i) with colleagues within the Company; (ii) with colleagues within the DKSH Group (both in the country where you are applying for a position, and in other countries in which the group has operations (including countries outside your country); and (iii) with third parties as described in this Notice.   

In case of transfers outside the your country, we will ensure appropriate safeguards, such as the Standard Contractual Clauses, Binding Corporate Rules, or other legally acceptable mechanisms that ensure an adequate level of protection.  

7. Data Retention 

Our general approach is to retain candidate Personal Data for one year from completion of the last vacancy you applied for, to the extent you were a suitable candidate for the vacancy, so that we may consider you for future job openings, unless you expressly object. In all cases, we will retain your Personal Data for exercising or defending legal claims, for a period of time corresponding to the applicable statute of limitations, or legal or regulatory obligations. 

If you accept employment with Company, your Personal Data will be held on the basis set out in our Employee Privacy Notice, which is provided to all employees and that you will be required to acknowledge that you have read. 

8. Your Rights 

• Right to Access - you have the right to request access to any of your Personal Data that the Company may hold, and to obtain information about the processing of that data.    
• Right to Correct - the Company will take steps in accordance with applicable legislation to keep your Personal Data accurate, complete and up-to-date. You are entitled to have any inadequate, incomplete or incorrect Personal Data corrected (that is, rectified). You also have a responsibility to ensure that changes in personal circumstances are notified to the Company so that we can ensure that your Personal Data is up-to-date. 
• Right to Withdraw Consent - in the event your Personal Data is processed on the basis of your consent, you have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.  
• Data Portability – under certain circumstances, you have the right to receive all such Personal Data which you have provided to the Company in a structured, commonly used and machine-readable format, and also to require us to transmit it to another controller where this is technically feasible. 
• You also have the right to lodge a complaint with the supervisory authority of your habitual residence, place of work or place of alleged infringement, if you consider that the processing of your Personal Data infringes applicable law.
